Certain documents from other civil Smoking and Health cases in the United States are also available through the on-line document archives.

Almost all of the documents that were produced in these cases are available to the general public, with the exception of a limited number of documents that raise personal/privacy concerns or contain certain third-party information covered by contractual confidentiality obligations. These documents are available to litigants and their lawyers who have signed the appropriate protective orders in their respective jurisdictions.

The parties reserve all rights under any applicable laws or rules concerning use, authenticity or admissibility in any litigation or proceeding of documents available through the On-line documents archives or at the Minnesota Tobacco Document Depository. In addition, all visitors to this site and each of the On-line document archive sites should understand the following:

  • The documents produced in the various Smoking and Health cases in the United States and available on-line are a subset of a larger collections of documents.  Therefore, numbering gaps often appear between documents.
  • The indices rely upon human coding of millions of documents. While efforts were made to insure the indices are accurate and complete, discrepancies may occur.
  • The available documents may contain copyrighted material whose use, including reproduction, is governed by United States copyright law (Title 17, United States Code). The law may permit the "fair use" of a copyrighted work, including the making of a photocopy, "for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship or research." 17 U.S.C. § 107. Persons obtaining, or later using, a copy of copyrighted material in excess of "fair use" may become liable for copyright infringement. Each person who obtains copies from the document archives or the Minnesota Tobacco Document Depository is responsible for ensuring his or her compliance with applicable copyright laws.
